New Hampshire Department of Agriculture Rulemaking Notices
   
 

In accordance with state law RSA 541-A:6, III, notice of rulemaking proceedings shall be provided.  The following identifies current rule proposals as filed by the Department with the Director of New Hampshire Rulemaking:

   
 

Division of Pesticide Control:
PES 200, 300 and 400
The New Hampshire Department of Agriculture, Markets & Food (the Department), Pesticide Control Board, will hold a public hearing on proposed amendments to the NH Code of Administrative Rules on Monday, May 7, 2012. The public hearing will be held in Room 201, on the second floor of the Department’s offices at 25 Capitol Street, Concord, NH. At 11 a.m.

At the hearing the Board will receive testimony from the public concerning the proposed adoption of Pes 200, 300 and 400 of Pesticide Rules. The purpose of this rule proposal is to continue without change rules that will expire on May 30, 2012. Chapter 200 is procedural rules including declaratory rulings and the process of appeals. Chapter 300 sets forth procedures for certificate of registration of private and commercial pesticide applicators. Chapter 400 covers continuing status of pesticide applicators, such as certificate renewals and recertification.

Division of Regulatory Services:
Agr 911:
The New Hampshire Department of Agriculture, Markets & Food, Division of Regulatory Services (the Department), will hold a public hearing on proposed amendments to the NH Code of Administrative Rules on Thursday, April 19, 2012. The public hearing will be held in Room 201, on the second floor of the Department’s offices at 25 Capitol Street, Concord, NH. At 2 p.m. on Thursday, April 19, 2012, the Department will receive testimony from the public concerning the proposed adoption of Agr 911: Organic Commodities Certification.

The Department will receive written comments on the proposed rules until 4 p.m. on Thursday, April 26, 2012. Division of Weights & Measures:
Agr 1412:
The New Hampshire Department of Agriculture, Markets & Food, Division of Weights and Measures (the Department), will hold a public hearing on proposed amendments to the NH Code of Administrative Rules on Thursday, April 5, 2012. The public hearing will be held in Room 201, second floor of the offices of the Department, 25 Capitol Street, Concord, NH. At 1 p.m. on Thursday, April 5, 2012, the Department will receive testimony from the public concerning the proposed re adoption with amendments of miscellaneous sections of Agr 1412: Dating Prewrapped Sandwiches. The purpose of this rule is to continue interim rules adopted on September 12, 2011. The rules define prewrapped sandwiches, their expiration date, and manufacturing date. The rules specify: 1) labeling requirements for fresh, refrigerated, and previously frozen prewrapped sandwiches to include manufacture and expiration date; 2) procedures for filing a complaint; 3) the agency’s inspection rights; 4) provisions for issuing orders to correct violations; and 5) vendor or retailer rights for appealing an order or requesting a waiver of a specific rule in Agr 1412.

Agr 1405:
In accordance with RSA 541-A:6, notice is hereby given that the New Hampshire Department of Agriculture, Markets & Food, Division of Weights and Measures (the Department), will hold a public hearing on proposed amendments to the NH Code of Administrative Rules on Wednesday, April 25, 2012. The public hearing will be held in Room 201, on the second floor of the Department’s offices at 25 Capitol Street, Concord, NH. At 9 a.m. on Wednesday, April 25, 2012, the Department will receive testimony from the public concerning the proposed adoption of Agr 1405.25-1405.38: Certification Seal Rules. The purpose of this rule is to continue interim rules Agr 1405.25-1405.30 that implemented SB 157 (eff. 7/1/2011), with the addition of the new Agr 1405.31-1405.38 rules on forms. The law now permits registered service technicians to affix certification seals to commercial weights and measures. These rules are intended to specify the seal definitions, design, cost, security and affixing procedures, as well as procedures for consumer complaints. The Department will receive written comments on the proposed rules until 4 p.m. on Wednesday, May 2, 2012.
